Czech Republic's Populist Prime Minister-Elect Refuses to Divest Corporate Holdings During Conflict-of-Interest Dispute

Andrej Babiš, the self-styled tycoon that won the recent Czech election, has declined to sell his vast corporate assets, while asserting he will resolve a ethical dilemma that might block him from assuming the role of prime minister.

Stance on Business Holdings

Babiš, whose ANO party came first in the autumn election but did not secure a majority in parliament, declared in a online statement that he would not divest his Agrofert conglomerate, which is active in farming, food production, and chemicals.

“I have consistently stated I will never sell Agrofert. I have consistently stated I will address the ethical issue in compliance with Czech and European laws,” Babiš remarked. “This is not like selling a pastry in a bakery.”

Head of State's Demand

The Czech president, Petr Pavel, stated that the 71-year-old political figure must clarify openly how he will eliminate conflicts of interest arising from his corporate dealings before assuming the role of prime minister.

The national charter “explicitly requires the head of state to consider the potential occurrence of a ethical issue and the possibilities for its resolution” when appointing government ministers, Pavel's office explained.

The head of state “wants it to be clear in what specific way Andrej Babiš will fulfil his constitutional and legal obligations”, the statement said, noting that Pavel was ready to designate Babiš as premier “without delay” once the issue was resolved.

Corporate Activities and Regulatory Concerns

Babiš's several hundred companies, primarily under the Agrofert group, function in the nation and other central European countries, receiving substantial funds in national and EU agricultural and other subsidies, as well as public contracts.

Under national legislation, government ministers are barred from receiving public aid or agreements. The ethics organization Transparency International has stated that to avoid a ethical breach, Babiš must either sell, refuse public contracts, or stay out of public office.

Previous Term and Current Plans
